DMCA Policy
Classic Mai Tai respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Classic Mai Tai will respond expeditiously to claims of copyright infringement committed using the Classic Mai Tai service and/or website (the "Site") if such claims are reported to Classic Mai Tai's Designated Copyright Agent identified in the sample notice below.
Filing a DMCA Notice of Infringement
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Classic Mai Tai's Designated Copyright Agent.
- Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail regarding the copyrighted work that you believe has been infringed upon (e.g., provide the title, author, and registration number, if applicable).
- Identification of the material that is claimed to be infringing: Provide sufficient detail to locate the material that you claim is infringing your copyrighted work on the Classic Mai Tai site. This must include, at a minimum, the specific URL(s) of the pages containing the alleged infringing material.
- Contact information of the complaining party: Provide your full legal name, mailing address, telephone number, and email address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the exclusive right that is allegedly infringed.
- Electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.

DMCA Counter-Notification
If you believe that material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting a written notification to our Designated Copyright Agent identified above. Pursuant to the DMCA, the Counter-Notification must include substantially the following:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled (e.g., the URL(s) of the specific page(s) on Classic Mai Tai's website).
- A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- The subscriber's name, address, and telephone number.
- A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside the United States, for any judicial district in which Classic Mai Tai may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
- Electronic or physical signature of the subscriber.
Upon receipt of a valid Counter-Notification, Classic Mai Tai will promptly forward a copy to the complaining party who submitted the original DMCA Notice. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the Counter-Notification.
